Terms and Conditions of Use

1. Acceptance of Terms

By accessing or using the image editing software (“Software”) provided by Omirel Technologies LLP (“Company”, “we”, “our”, or “us”), the user (“you”, “your”, or “User”) agrees to be legally bound by these Terms and Conditions. If you do not agree, you must not use the Software.

2. Use of Technology

Our Software uses proprietary technology as well as third-party services and APIs for AI-based image editing and enhancement. By using our Software, you agree to be bound not only by our Terms, but also by the Terms and Privacy Policies of all integrated third-party service providers (e.g., image models, AI engines, storage systems).

You acknowledge and agree that Omirel Technologies LLP is not responsible for any data processing or outcomes arising from third-party technologies used within the Software.

3. User Responsibility and Content Liability

3.1 User-Supplied Content

All content, including but not limited to images, graphics, and other media, uploaded or input into the Software by the User remains the sole responsibility of the User.

You represent and warrant that:

  • You own the rights to or have permission to use all materials submitted.
  • The content does not violate any copyright, trademark, privacy, or publicity rights of any third party.
  • The content does not contain any nudity, obscenity, defamation, hate speech, or any illegal or unlawful material.

3.2 Generated or Edited Outputs

Omirel Technologies LLP does not monitor, control, or endorse any content edited, generated, or output by the Software. You are solely responsible for all outputs created through your use of the Software.

You agree to indemnify and hold harmless Omirel Technologies LLP from any and all claims, damages, liabilities, and expenses arising from:

  • The use of copyrighted or unauthorized materials
  • Any offensive, defamatory, or illegal content generated or distributed using the Software
  • Any misuse or violation of applicable laws or rights of third parties

4. Prohibited Uses

You agree not to use the Software:

  • To create, edit, or distribute content that is pornographic, defamatory, misleading, hateful, or illegal
  • To infringe upon the intellectual property or privacy rights of others
  • For commercial deepfake creation, impersonation, or misinformation purposes

Any violation of this section may result in immediate termination of access and legal action where necessary.

5. Disclaimer of Warranties

The Software is provided on an “AS IS” and “AS AVAILABLE” basis. Omirel Technologies LLP does not make any warranties, express or implied, regarding:

  • Accuracy, reliability, or quality of the edited images
  • Availability or uninterrupted access
  • Compatibility with your devices or systems

We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

6. Limitation of Liability

In no event shall Omirel Technologies LLP or its affiliates, partners, employees, or licensors be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Any damages arising out of unauthorized or unlawful use of the Software

Our total liability for any claim arising out of or relating to the use of the Software shall not exceed the amount paid (if any) by the User for the service.

7. Modifications to the Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Software after changes constitutes acceptance of the revised Terms.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes or claims arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Pathanamthitta, Kerala, India.
